The guy doing the compilation & analysis uses a few unnecessary descriptive terms, but he covers the issue of moral responsibility on the part of everyone concerned. Salt Lake police fire detective involved in arrest of U of U nurse Wubbles


Salt Lake City — (KUTV) Salt Lake City police confirmed that the detective of a controversial arrest of a nurse at the University of Utah hospital has been fired.

An internal investigation concluded last month, but the decision to fire Detective Jeff Payne and demote Lt. James Tracy, also involved, became clear Tuesday. Payne arrested nurse Alex Wubbels who would not allow Payne to draw blood from an unconscious patient.

An appeal was already underway Tuesday.

“We are done, we are done, you are under arrest,” is what Payne said on his body camera video on July 26.

Video of the incident was given to the news media by attorney Karra Porter during a press conference with nurse Wubbels on Sept 2. She can be heard in the video screaming as she’s being hauled away:

You’re assaulting me stop! I’ve done nothing wrong! This is crazy! This is crazy

Salt Lake County District Attorney’s Office and Unified Police launched an independent criminal investigation of the arrest at the center of a now-viral video from the University of Utah ER.

Payne came to the hospital to get a blood sample from a victim in a fatal car crash in Cache County that happened earlier in the day. Wubbels would not allow him to get that sample saying he did not meet one of the three requirements for drawing blood. He didn’t have a warrant, the patient didn’t give consent and the patient was not under arrest.

Wubbels had the backing of her supervisors and others in the hospital. One of them was on the phone with her and could be heard telling Payne: “Sir you are making a huge mistake right now”

Payne wouldn't take no for an answer, and that is when the arrest was made.

News of the arrest, including body-cam footage from police and an exclusive KUTV interview with Wubbels spread nationwide.

Nurse Settles over Rough Arrest Caught on Video

SALT LAKE CITY (AP) — A Utah nurse who was arrested for refusing to let a police officer draw blood from an unconscious patient said Tuesday that she was settling with Salt Lake City and the university that runs the hospital for $500,000.

Nurse Alex Wubbels and her lawyer, Karra Porter, announced the move nearly two months after they released police body-camera video showing Detective Jeff Payne handcuffing Wubbels. The footage drew widespread attention online amid the ongoing national conversation about police use of force.

The settlement covers all possible defendants in a lawsuit, including individual police officers and hospital security officers, and the payout will be divided among the city and the University of Utah.

Wubbel was following hospital policy when she told Payne he needed a warrant or the consent of the patient to draw blood after a July 26 car crash. The patient was not under arrest or suspected of wrongdoing.

Payne had neither. He eventually dragged Wubbels outside and handcuffed her as she screamed that she had done nothing wrong.

She was released without being charged but has said the incident left her feeling terrified and bullied. In a call for changes, Wubbel and her lawyer released the video they had obtained through a public records request.

Salt Lake City Police Chief Mike Brown has since apologized and fired Payne after an internal investigation found he violated department policies.

Brown said in a disciplinary letter that he was “deeply troubled” by Payne’s conduct, which he said brought “significant disrepute” on the department.

Payne is appealing that decision, saying the firing was an unfair reaction to the negative publicity.

The patient was an off-duty Idaho reserve police officer driving a semitrailer when he was hit by a man fleeing police in a pickup truck. He later died of his injuries.

Lt. James Tracy, a police supervisor who ordered the arrest of the nurse, was demoted to officer and also is appealing. He said he suggested Payne consider handcuffing the nurse and that his superiors had never informed him of the hospital’s blood-draw policy, according to appeal documents.

I do like what she wants to do with part of her settlement:

Wubbels said she plans to use a portion of the settlement toward a new initiative to help others pay for access to police body camera video clips.

“Any person in the State of Utah who wishes to obtain body cam footage of an incident involving them will be able to do so, no charge to them. Our law firm, Christensen & Jensen, will provide any legal services necessary to accomplish that,” Porter said. “Thanks to Alex, there will be more transparency.”

I have to wonder about the police chase aspect to this tragedy. It may or may not have been a 'high speed' chase, but several squad cars were in pursuit of the pickup driving erratically. When the pickup crossed into oncoming traffic it hit the semi being driven by William Gray who was critically burned.
