– City officials have signed a U.S. Justice Department agreement to overhaul Albuquerque police. Families of those fatally shot by officers say they are pleased with the blueprint. And advocates are praising police for peacefully ending recent standoffs.
Still, Albuquerque may see another round of angry protests.
Federal and state officials have not said if officers involved in the March high-profile shooting death of homeless camper James Boyd will face charges. The FBI said it was investigating the shooting, and an internal investigation of the shooting has been turned over the Bernalillo County District Attorney Kari Brandenburg’s Office.
Some advocates say not indicting officers will generate demonstrations similar to those that paralyzed Albuquerque earlier this year. “It could set off some unrest, no question,” said Ralph Arellanes, president of the LULAC Albuquerque chapter and a critic of the police department. “Everyone is keeping an eye out on that case and we want justice served.”
The 38-year-old Boyd was shot in the foothills of the Sandia Mountains during an hours-long standoff with Albuquerque police. Video from an officer’s helmet camera showed police fired on Boyd, who had struggled with mental illness, as he appeared to be preparing to surrender.
Days later, a demonstration that drew national attention turned violent, leading police to use tear gas on protesters who halted traffic, threw rocks and bottles, and damaged property.
Albuquerque Mayor Richard Berry said the city welcomed any peaceful protests that may come in the coming month

undercover police in Denver targeted suspected drug dealer David Flores for arrest. Flores allegedly put a sock full of heroin in his mouth. Uniformed cops showed up to help in the arrest and one of them punched Flores six times in an effort to get him to spit the drugs out. When cops saw a bystander recording the incident with his tablet, they seized it. When they returned it to the bystander, Levi Frasier, the video was deleted, but a few months later he realized the video had been uploaded to a cloud.

He made the video available to Fox 31 in Denver, which did not release it in its entirety because it shows undercover cops on tape. Fox 31 reports on its contents:

The videotape shows [Officer Christopher] Evans holding down the suspect’s legs. A burly undercover officer can be seen bear-hugging Flores, lying on his side on the asphalt parking lot. Flores has his hands pinned behind his back.

[Officer Charles] Jones can be heard yelling at Flores to, “Spit the drugs out! Spit the drugs out!”

When Flores fails to open his mouth, Jones punches him with a closed fist six times in the face.

The video shows the suspect’s head bouncing off the pavement as a result of the force.

And then:

While Jones was punching Flores, the video captures the loud sounds of a woman screaming in Spanish for police to stop.

A few seconds later, a visibly pregnant woman approaches the area where the officers are on top of Flores. Jones reaches out and sweeps her feet out from under her.

It appears on video, the woman, 25-year-old Mayra Lazos-Guerrero, falls hard on her stomach and face.

Jones reported to a superior he thought the woman was going to kick him.

Frasier disagrees with that and describes the punches he saw thrown: “Those were the hardest punches I have ever heard. I’ve seen some people get punched in the ring and on TV and whatnot, but the sound of those resonating

A detective for the Los Angeles Police Department who once investigated sexual assault cases killed himself Thanksgiving morning after two relatives accused him of sexually abusing them, authorities said Friday.

Police Who Shattered Window, Tased Passenger in Viral Traffic-Stop Video Were Reinstated


In October, a video of police in Hammond, Indiana, smashing open a car window and using a stun gun on a man in the car's front passenger seat became a national news story. The vehicle had been stopped because its driver, Lisa Mahone, was not wearing a seat belt, and the video was shot by one of her children in the back seat. The man being stunned, Jamal Jones, had told officers he was not carrying a driver's license and refused to get out of the car; he was cited for "resisting law enforcement, failure to aid an officer and not wearing a seat belt." Mahone and Jones filed a lawsuit and appeared on the Today show; the two officers involved were placed on limited duty.

It was with significantly less fanfare on Nov. 24 that the mayor of Hammond announced he'd reinstated the officers to regular duty because they'd been "cleared" by an FBI investigation—only for the FBI to respond that it had done no such thing.

Sacramento >> A former Anderson police officer was sentenced Friday to five years in prison for violating the civil rights of a woman he arrested by sexually assaulting her while she was in his custody.

Bryan Robert Benson, 30, of Shasta Lake, entered a guilty plea to the offense on May 30 in the US District Court for the Eastern District of California.

The federal indictment charged Benson with deprivation of rights under color of law in connection with the sexual assault of a woman he had placed under arrest on May 29, 2010.

— The U.S. Supreme Court declined to hear the appeal of a former Washington state police officer convicted of using excessive force in the 2006 death of a developmentally disabled janitor he wrongly suspected of theft, a case that helped lead to a federal review of the Spokane Police Department.
The high court issued the denial Monday for former Officer Karl Thompson Jr., who is serving a four-year prison sentence tied to Otto Zehm's death. Thompson's attorneys contended that jurors heard evidence that legally should have been withheld, The Spokesman-Review reported Wednesday.
The decision ends a two-year appeals process for Thompson, who is scheduled to remain in a low-security facility in Arizona until July 2016. He was convicted in 2011 of violating Zehm's civil rights by using excessive force and trying to conceal evidence.
Thompson's attorney, Carl Oreskovich, said the decision was not surprising given the large volume of requests the nation's highest court receives. He said he had not yet discussed plans for further litigation.
Local prosecutors initially cleared Thompson of wrongdoing in his confrontation with Zehm, which took place in a convenience store on March 18, 2006. Witnesses reported seeing Thompson strike the 36-year-old janitor multiple times with a baton, shoot him with a stun gun and hog-tie him after Thompson responded to a theft report that turned out to be false. Zehm died a few days later.

DEA Program Manager Charged in Credit Card Fraud Involving $115,000; Prosecutors Allege She Took Out 33 DEA Credit Cards

A DEA program manager from Maryland has been charged in a fraudulent scheme involving DEA credit cards.

She’s charged with using the cards to withdraw from ATM machines about $115,000 for her own use.

Keenya Meshell Banks, age 41, of Upper Marlboro, Md. is charged in a criminal complaint with access device fraud, wire fraud and aggravated identity theft. She made her initial appearance on Thursday in U.S. District Court in Greenbelt.



According to the press release:

Specifically, Banks allegedly submitted applications that included the names and identifying information of individuals who did not work for DEA and therefore were not eligible to receive DEA government credit cards. On at least one occasion, Banks submitted an application that matched a current DEA employee. The employee never received the card and Banks allegedly used the personal information of the employee without the employee’s knowledge or approval. The credit cards were ordered by Banks via email, and the cards were sent to Banks via Federal Express or other mail, based on her certification on the applications.

The criminal complaint alleges that Banks used the cards at Automated Teller Machines in Maryland and Northern Virginia, withdrawing approximately $115,841.74 over the course of the scheme. No payment was ever made to the credit card issuer.

WASHINGTON—Twelve former Puerto Rico police officers have been sentenced for using their law enforcement affiliation and equipment to commit robbery and extortion, and to sell illegal narcotics and manipulate court records.



The following 12 defendants have been sentenced:

Osvaldo Vazquez-Ruiz was sentenced to 138 months in prison. Vazquez-Ruiz pleaded guilty on Aug. 21, 2014, to conspiracy to violate the Racketeer Influenced and Corrupt Organizations Act (RICO) and carrying a firearm during and in relation to a crime of violence.
Orlando Sierra-Pereira was sentenced to 157 months in prison. Sierra-Pereira pleaded guilty on Aug. 21, 2014, to conspiracy to violate RICO and carrying a firearm during and in relation to a crime of violence.
Danny Nieves-Rivera was sentenced to 157 months in prison. Nieves-Rivera pleaded guilty on Aug. 21, 2014, to conspiracy to violate RICO and carrying a firearm during and in relation to a crime of violence.
Roberto Ortiz-Cintron was sentenced to 154 months in prison. Ortiz-Cintron pleaded guilty on Aug. 21, 2014, to conspiracy to violate RICO and carrying a firearm during and in relation to a crime of violence.

Eduardo Montañez-Perez was sentenced to 63 months in prison. Montañez-Perez pleaded guilty on Aug. 15, 2014, to conspiracy to violate RICO.
Carlos Candelario-Santiago was sentenced to 63 months in prison. Candelario-Santiago pleaded guilty on Aug. 15, 2014, to conspiracy to violate RICO.
Ruben Casiano-Pietri was sentenced to 78 months in prison. Casiano-Pietri pleaded guilty on Aug. 21, 2014, to attempted Hobbs Act robbery.
Ricardo Rivera-Rodriguez was sentenced to 33 months in prison. Rivera-Rodriguez pleaded guilty on Aug. 25, 2014, to attempted Hobbs Act extortion under color of official right.
Christian Valles-Collazo was sentenced to 78 months in prison. Valles-Collazo pleaded guilty on Aug. 21, 2014, to attempted Hobbs Act robbery.
All 12 of the above defendants were sentenced by Senior U.S. District Judge Daniel R. Dominguez of the District of Puerto Rico, and the remaining four defendants convicted in this case are scheduled to be sentenced in January 2015. At the time of the crimes, Flores-Villalongo and Candelario-Santiago were sergeants with the Police of Puerto Rico; the others were police officers.

The officers convicted of the RICO conspiracy admitted to being members of a criminal organization that sought to enrich its members through a pattern of illegal conduct. Over the course of the conspiracy, the officers worked together to conduct traffic stops and enter homes or buildings used by persons suspected of being engaged in criminal activity to steal money, property and narcotics. The officers also planted evidence to make false arrests, and then extorted money in exchange for their victims’ release from custody. In exchange for bribe payments, the officers gave false testimony, manipulated court records and failed to appear in court when required so that cases would be dismissed. Additionally, the officers sold and distributed wholesale quantities of narcotics.

As just a few examples of their criminal conduct, in April 2012, Vazquez-Ruiz and Sierra-Pereira conducted a traffic stop in their capacity as police officers and stole approximately $22,000 they believed to be illegal drug proceeds. Vazquez-Ruiz later attempted to extort approximately $8,000 from an individual he believed to be a drug dealer’s accomplice in exchange for promising to release an alleged prisoner.

Further, in November 2012, Sierra-Pereira, Nieves-Rivera, Ortiz-Cintron and Valles-Collazo illegally entered an apartment and stole approximately $30,000, which they believed was illegal lottery proceeds.

The defendants frequently shared the proceeds they illegally obtained and used their power, authority and official positions as police officers to promote and protect their illegal activity. Among other things, the defendants used their police firearms, badges, patrol cars, tools, uniforms and other equipment to commit the crimes and concealed their illegal activity with fraudulently obtained court documents and falsified police paperwork to make it appear that they were engaged in legitimate police work.

FBI Agent Pleads Guilty to Trading Docs for Bribes

A Westchester-based FBI agent pleaded guilty Tuesday to trading government files on a "prominent" Bangladeshi politician for bribes.
Robert Lustyik, 52, faces up to 55 years in prison after pleading guilty to all five counts which he was charged.
The Sleepy Hollow man had pleaded guilty this past October to a separate, 11-count indictment in Salt Lake City. He was slated to go to trial in New York on the bribery after two of his co-conspirators pleaded guilty.
U.S. District Judge Vincent Briccetti accepted Lustyik's latest plea "to (1) conspiracy to engage in a bribery scheme; (2) soliciting bribes by a public official; (3) conspiracy to defraud the citizens of the United States and the FBI; (4) theft of government property; and (5) unauthorized disclosure of a Suspicious Activity Report.
The allegations to which Lustyik pleaded guilty on Tuesday concerned his actions from September 2011 through March 2012, representing the end of a 24-year career with FBI, most recently on the counterintelligence squad in White Plains, N.Y.
Rizve "Caesar" Ahmed, a co-conspirator who faces sentencing in January, sought information, including a suspicious activity report, on a "prominent Bangladeshi political figure who was affiliated with a political party opposing [his] views."
Lustyik and his co-defendant Johannes Thaler solicited bribes from Ahmed in exchange for "internal, confidential documents and other confidential information to which Lustyik had access by virtue of his position as an FBI special agent," the Justice Department said in a statement Tuesday.
"Ahmed perceived himself to be on the opposite side of a political rivalry with" the Bangladeshi political figure in question, prosecutors said, identifying this man only as "Individual 1."
"Ahmed sought, among other things, to obtain information about Individual 1, to locate Individual 1, and to harm Individual 1 and others associated with Individual 1," the DOJ statement continues.
Prosecutors described text messages between Lustyik and Thaler in which they plotted how to get more money from Ahmed for confidential information.
"For example, in text messages, Lustyik told Thaler, 'we need to push [Ahmed] for this meeting and get that 40 gs quick . . . . I will talk us into getting the cash . . . . I will work my magic . . . . We r sooooooo close.'"
Thaler responded: "I know. It's all right there in front of us. Pretty soon we'll be having lunch in our oceanfront restaurant," the Justice Department said.
When Ahmed apparently had a different source in mind to provide him with confidential information, his text to Thaler was enraged.

Former Deputy Waives Preliminary Hearing

A former Leflore County deputy sheriff facing federal drug trafficking charges has waived a preliminary hearing scheduled for Tuesday in federal court in Oxford.

Federal prosecutors say Mark Head is charged with one count of attempted distribution of cocaine. Prosecutors allege Head was paid $1,500 to pick up about one kilogram of cocaine for a Leflore County drug dealer in Little Round Park

Huntsville police officer indicted on federal bribery charges

Posted: Monday, December A Huntsville police officer arrested earlier this month by the FBI has been indicted by a federal grand jury.
The U.S. Attorney's Office for the Northern District of Alabama said Monday morning Lewis Bernard Hall, 45, is charged with conspiracy, bribery, obstruction of justice and making a false statement to investigators.
Hall is accused of trying to fix cocaine trafficking charges.
