'Sister Wives' Defeat Polygamy Law in Federal Court

A federal judge ruled late Friday that a key section of Utah law criminalizing polygamy is unconstitutional, granting multi-spouse families the right to live together without facing arrest, so long as they do not acquire multiple marriage licenses.

U.S. District Court Judge Clark Waddoups ruled Utah's criminalization of cohabitation violated the due process and First Amendment religious freedom rights of the Brown family, which includes husband Kody Brown and his four wives.

The Browns are fundamentalist Mormons and the stars of TLC show "Sister Wives." They chose to leave their home in Lehi, Utah, after local police and prosecutors launched an investigation into their lifestyle in 2010. Before moving to Las Vegas, a deputy Utah County attorney said, "The Browns have definitely made it easier for us by admitting to felonies on national TV."

The Brown family's attorney, George Washington University law professor Jonathan Turley, praised the ruling as a landmark in the legal history of individual rights.

Polygamist rights advocates are pleased by the ruling.
Now that we're no longer felons, that's a huge relief, Anne Wilde, co-founder of advocacy group Principle Voices, told The Associated Press.
Utah Gov. Gary Herbert, a Republican, told the Salt Lake Tribune Saturday he was "a little bit jaundice-eyed" and needed to review the decision and its ramifications. But, the governor said, "I'd much rather see decisions on social issues come from our legislature representing the will of the people."

The truth of the matter is that Government practices tyranny when it passes and enforces any law concerning marriage including marriage licenses.
Marriage is instituted by God, not man. Man has not the power to give to the government and God didn't.

I believe what Kody Brown is doing is morally wrong, but aside from that, it's not against the law to sleep with a lot of different people and have children with them without being married to any of them, so why should it be against the law to call them all your wives and live with them. As long as the man does not have legal marriage licenses for all his "wives," it shouldn't matter what he calls them. They are still his girlfriends and/or mistresses, and his legal wife has consented to live in an "open" marriage.

The government ought to stay out of the bedroom.

To me polyamory is the ability and desire to openly, honestly, and romantically love more than one person at a time. Many people find that polyamory offers a more authentic way of expressing who they are and the love they have to share.

Who are the polyamorists, you ask? They come from all walks of life. There is no particular criteria in terms of social class, personal wealth, religion, race, sexual orientation, age, political philosophy or world view. Much more important are honesty, openness, trust, love, commitment, patience, and egalitarianism.

Monogamy is an equally valid way to love and is more suitable for some. Polyamory is no better and no worse, but instead simply another valid way of expressing love and devotion.

Polygamy is an eternal truth.
Monogamy is not.
