I have always believed Kessler was a FBI Media Asset

Was Ron Kessler a CIA Journalism Asset?
Dec 11, 2014 12:17 PM EST
The author of The CIA at War pushes back against a Senate Report insinuation.

In 2003, Ronald Kessler, the writer known today for breaking the news that U.S. Secret Service agents solicited prostitutes while in Colombia, published a book called The CIA at War. It included an impressive trove of classified information—of the sort that can launch federal investigations, followed by journalist subpoenas (as to the New York Times’ James Risen), and sometimes ending with leakers (like former CIA agent John Kiriakou) in jail. Kessler wrote, for instance, that Khalid Sheikh Mohammed, whom the 9/11 commission named the chief architect of the 9/11 attacks, “told the CIA about a range of planned attacks—on U.S. convoys in Afghanistan, nightclubs in Dubai, targets in Turkey, and an Israeli embassy in the Middle East.” He wrote that Abu Zubaydah, a prisoner from Al Qaeda, offered intelligence on “planned plots.” (The detainee was “singing” with information, Kessler said.) But the Senate Intelligence Committee's report on torture, released Tuesday, called these statements “incongruent” with CIA records. It noted that CIA officials had “provided assistance” with Kessler’s book, in order to “shape press reporting on the CIA’s Detention and Interrogation Program.” The Senate report quotes then-Senior Deputy General Counsel John Rizzo saying that the Director of the CIA “blessed” Kessler with agency cooperation. It seems to paint Kessler as something of a chosen mouthpiece, the person in whom the CIA put its faith.

Kessler believes that the Senate report’s implication that he is any kind of preferred journalist, an asset and dissemination tool, is outrageous. “I’m not some kind of patsy,” he said by phone on Wednesday evening. He said that he followed “standard operating procedure for journalism. They tried to make it into some nefarious plot to bamboozle me. It’s not.”

The secret life of J Edgar Hoover

For half a century, the FBI director waged war on homosexuals, black people and communists. Now, a controversial film by Clint Eastwood is set to reveal some of the explosive truth about him. Here, his biographer Anthony Summers tells all

Saturday 31 December 2011 19.06 EST

J Edgar Hoover was a phenomenon. The first Director of the FBI, he remained in office for 48 years, from his appointment after the First World War to his death in 1972, achieving fame and extraordinary power. For public consumption when he died, President Richard Nixon eulogised him as: "One of the giants… a national symbol of courage, patriotism and granite-like honesty and integrity." He ordered flags to fly at half-mast and that Hoover's body lie in state in the Capitol.

In private, on hearing that he had died, Nixon had responded merely: "Jesus Christ! That old coc*****ker!" Months earlier, closeted with key advisers, he had held forth on the need to persuade the elderly Hoover to resign. "We have on our hands here a man who will pull down the temple with him, including me."

Nixon, soon to be disgraced and forced to resign, was of course himself no paragon. Most presidents before him, though, had had cause to fear Hoover or been troubled by what his FBI had become. Harry S Truman wrote during his presidency: "We want no Gestapo or secret police. FBI is tending in that direction. They are dabbling in sex-life scandals and plain blackmail… Edgar Hoover would give his right eye to take over, and all congressmen and senators are afraid of him."

Hoover himself, meanwhile, had a personal secret that – in his era – could have destroyed him if revealed. Clint Eastwood referred to it this year before the launch of his movie, when he assured the J Edgar Hoover Foundation that J Edgar would not "portray an open homosexual relationship" between Hoover and his long-time male companion, Clyde Tolson.

Eastwood stretched the truth. Though there is just one passionate kiss between Leonardo DiCaprio and Armie Hammer, the two actors portraying them in the movie, the relationship with Tolson is a central theme. In real life, all Washington knew was that the pair dined daily together, vacationed together, did everything but move in together, and the whispers flew. When a magazine article in the 1930s referred to Hoover's "mincing" gait, and a diplomat commented on his "conspicuous perfume", Hoover struck back. He gathered derogatory information on the offending journalist, and asserted – falsely – that he did not use perfume. Real information on the Hoover-Tolson relationship surfaced only long after both men were dead, during research for my book.

A surprising find was the account by Luisa Stuart, once a celebrated model, tracked down because she featured in a droll photograph taken with Hoover and Tolson one New Year's Eve in the late 1930s at the Stork Club – the place to be seen in New York at the time. In the photo, Hoover is shown holding his hands up as Stuart, armed with a toy shotgun, "threatens" him. Later that night, in the dark of a limousine when they left the club, she remembered: "I noticed they were holding hands all the way, just sitting there talking and holding hands with each other… I was so young and those were different times. But I'd never seen two men holding hands."

Joseph Shimon, a former Washington police inspector, recalled a taxi driver reporting the pair had been "kissing and @#$-grabbing" during a cab journey. Harry Hay, founder of America's first gay rights group, remembered that on vacation in California, in "a circle in which they didn't have people who weren't gay… They were nodded together as lovers."

The Eastwood movie includes a bizarre scene that depicts Hoover, after his mother's death, donning one of her dresses. It is a nod towards allegations I first reported, that he on occasion cross-dressed. I had information from three sources, two men who said an "easily recognisable" photograph of Hoover in an evening gown circulated in the gay community in 1948, and an account by a millionaire's former wife of secret sex parties that she claimed to have witnessed in the late 50s. Hoover, the woman said, had been "dressed like an old flapper, like you see on old tintypes".

Bill Clinton, who as president in 1993 was mulling over who to appoint as FBI Director, thought the cross-dressing reports were hilarious. "It's going to be hard," he grinned during a speech at a press function, "to fill J Edgar Hoover's… pumps." That I published such allegations at all, however, to this day draws roars of fury from old Hoover loyalists.

Other accounts of the Director's alleged sexual activity, if true, would certainly have destroyed him had they become public. A former Bureau inspector and trusted associate named Jimmy Corcoran said years later that Hoover, youthful at the time, had once asked him to deal with a serious "problem". He had been arrested on sex charges involving a young man during a trip to New Orleans. Corcoran, who had powerful contacts in the state, said he intervened to hush the matter up.

There is, too, a claim that as late as 1969, when Hoover was in his early 70s, he dallied with teenage boys during

Taxpayer funded FBI agents have placed informants in low level to upper level management positions in radio, television and print media.
In place for over 60 years these informants provide the eyes and ears for the FBI Rapid Response Team set up to neutralize any negative press about the death squad activities of FBI agents.

This team has been successful in keeping the evidence out of the media of the FBI 's assassination of President Kennedy and Martin Luther King.
More recently the FBI has managed to cover up it's role in creating the 1993 1st World Trade Center bombing; Oklahoma City bombing; 911; Boston Marathon bombing; Omargh bombing in Ireland and the Mumbai Terrorist Attack in India .FBI agents also took the lead role in the coverup of the Lockerbie Plane bombing and the explosion of TWA Flight 800 over Long Island.

Some examples of the FBI control of media had the History Channel stop showing and selling it's documentary about the the FBI role in assassinating President Kennedy called THE GUILTY MEN see http://www.maryferrell.org/wiki/index.p ... ed_Kennedy" onclick="window.open(this.href);return false;

Redacted in 4-Page Document About the FBI’s ‘Sensitive Informant Program’
December 5, 2013
Salt Lake City attorney Jesse Trentadue has received three heavily-redacted batches of recently-declassified documents from the FBI in recent days as partial responses to his ongoing quest for materials related to the Bureau’s “Sensitive Informant Program.” The most recent document, however, could qualify as the most-heavily-redacted document ever offered in response to a Freedom of Information Act request. Everything — four pages in all — is redacted! See pics below.

OKC FBI TRANSP 3OKC FBI TRANSP 4
In an email message Thursday morning, Trentadue describes this latest set of documents as “certainly in line with the Administration’s position on FOIA and the need for ‘transparency.’”
Trentadue has sought details about the “Sensitive Informant Program” in an effort to learn more about the brutal death of his brother, Kenneth Trentadue, under suspicious circumstances while in custody at the U.S. Bureau of Prisons Federal Transfer Center in Oklahoma City in 1995 and about the connection he believes exists between his brother’s death and the investigation of the Oklahoma City Bombing.
As I reported in a Nov. 21 update to this post, federal Judge Clark Waddoups has set May 5, 2014, as the date on which a new Oklahoma City Bombing trial will begin in the U.S. District Court for the District of Utah, Central Division. The trial will begin at 8:30 a.m. local time, is expected to last three days and could produce some bombshells.

The Sensitive Informant Program** is the FBI’s disturbing practice of using private citizens as spies on the staffs of members of Congress and perhaps even federal judges, in the national media, within other federal agencies, on defense teams in high profile federal and/or state criminal prosecutions, inside state and local law enforcement agencies and even among the clergy of organized religions. The Sensitive Informant Program is designed to and does result in the circumvention of the protections guaranteed to American citizens by the Bill of Rights and the Separation of Powers Doctrine.

FBI RELEASES REDACTED INFORMANT MANUALS IN RESPONSE TO FOIA

Documents obtained by Salt Lake City attorney Jesse Trentadue reveal new details about the FBI's rules of conduct for informants.

The FBI released 147 pages of heavily redacted manuals and policies related to the use of informants, in response to a FOIA request by Trentadue, who is engaged in a years-long lawsuit with the FBI over documents related to the Oklahoma City bombing.

Read the documents herehere

http://news.intelwire.com/2012/10/fbi-r ... nuals.html" onclick="window.open(this.href);return false;

The documents pertain to unspecified training for "confidential human sources," including chain of command, dispute resolutions and other topics. The vast majority of direct guidance to informants is redacted, including even chapter headings.

Trentadue filed a related complaint alleging that the FBI has engaged in a practice of using informants within the news media to receive advance notice of potentially unfavorable stories.

As an exhibit in that complaint, Trentadue submitted an FBI FD-302 record related to a previously reported claim that the Oklahoma City bombing had been carried out by Iraqi intelligence agents, a lead that was of dubious origin and that did not ultimately pan out. The document was previously published on INTELWIRE.

The document states the FBI received information about the Iraq allegation from "a senior official employed by ABC news for over fifteen years," The source had been assigned an identification number and "had provided highly accurate and reliable information in the past."

But that’s another story.

Smith, who used to be my next-door neighbor along with her handsome hubby, former FBI agent Tom Smith —who once popped a squirrel in my backyard — has written an account of her relentless pursuit of the Chicago Outfit and mobster Ken Eto — when she was one of only a few female FBI special agents at the time.

Female FBI agent charged with beating her partially blind father

Published: Thu, March 29, 2012 @ 3:11 p.m.
YOUNGSTOWN — A 46-year-old woman, who police listed as a former FBI agent, has been charged with domestic violence for allegedly assaulting her partially blind father this week.

Police arrested Sheila Lawson on Wednesday on Katherine Street on the city’s East Side. Officers were sent to the home when Lawson’s father called saying his daughter is under stress about getting her job back and had yelled screamed and hit him.

The man told police Lawson hit him in the back of his head and on the shoulder. Lawson told police she did hit her father because he was getting on her nerves.

The father, while police were investigating the matter, told his daughter, “You need help. That’s why they kicked you out of the FBI.”

The statement, reportedly sent Lawson into a frenzy, causing her to curse the man and punch him in the head in front of officers.

Lawson still threatened to do her father bodily harm as she was being led away by police.

The unit was formed earlier this month to specifically combat public corruption in the Rio Grande Valley and serve as a long-term tool to restore the public's trust, said Rock Stone, an FBI supervisory special agent.

Media comment on today's GAO assessment of the FBI's flawed anthrax science
I chose the following short AP report from the WaPo because it gets right to the point:
NATIONWIDE (AP) - The Government Accountability Office says the science the Federal Bureau of Investigations used to investigate the 2001 anthrax attacks was flawed.
The GAO released a report Friday on its findings. The agency didn't take a position on the FBI's conclusion that Army biodefense researcher Bruce Ivins acted alone in making and sending the powdered spores that killed five people and sickened 17 others.
The report adds fuel to the debate among experts, including many of Ivins' co-workers at Fort Detrick in Frederick, Maryland, over whether Ivins could have made and mailed the anthrax-filled envelopes.
The GAO said the FBI's research did not provide a full understanding of the methods and conditions that give rise to genetic mutations used to differentiate between samples of anthrax bacteria. The report calls this a "key scientific gap."
This is the crux of the matter. Yet FBI has said it stands by its case.

UPDATE: "A spokesman for the FBI said the agency does not intend to reopen the case."

Why would FBI say anything else? They have no need to provide any arguments or evidence, having successfully hounded one of their (several) suspect scientists until he committed suicide. Recall that FBI floated many different theories of the case before settling on Ivins as the perpetrator, a full 6-7 years after beginning its investigation.

They tried to close the case then, in August 2008. But some in Congress were highly dissatisfied, so at a September 2008 hearing in which he was the only witness, FBI Director Mueller promised a review of the scientific evidence by the National Academy of Science (NAS).

An excellent team was assembled by the Academy, and they set to work. But FBI learned the committee was doing too thorough a job, and its findings did not favor the FBI's claims in the case. So FBI did an end run around the NAS, closing its case and issuing this report in 2010, long before the NAS was ready with its 2011 report.

Once the NAS report came out, FBI sang a different tune. It wasn't the science that was definitive; rather, it was the totality of the forensic evidence.

Except: what evidence was FBI referring to? There was no direct evidence linking Ivins to the crime, nor evidence it was even possible to manufacture a sufficient quantity of spores in the Army facility where he worked.

Here's what the FBI still claims about its case, despite everything:
"...New scientific methods were developed that ultimately led to the break in the case—methods that could have a far-reaching impact on future investigations.
So the new scientific methods broke the case-- except they were in fact inconclusive and have not stood up to scrutiny by either the NAS or the GAO. In fact, no agency or group besides the FBI has given them any credence. Members of Congress remained unsatisfied, like Senator Grassley.

Today, outgoing Congressmember and physicist Rush Holt (who requested the GAO study and will lead the AAAS next month) said the report:
“confirms what I have often said — that the F.B.I.'s definitive conclusions about the accuracy of their scientific findings in the Amerithrax case are not, in fact, definitive. The United States needs a comprehensive, independent review of the Amerithrax investigation to ensure we have learned the lessons from this bio attack.”

GAO Report echoes NAS report that FBI' s study of anthrax letters leaves much to be desired, including lack of validation of the methods used/GAO
Here is the GAO report released today, two years in the making, a study done for unnamed "congressional requesters." In past years, the requesters have been listed, but in this case, they are not. This most likely reflects the sensitivity of this matter. Why so sensitive?

Because the FBI botched its investigation, never had even the shred of a case against Ivins, and this is not the first time they were called out on it. The 2011 National Academy of Science (NAS) report pointed out the same things as this GAO report: that FBI and its contractors developed methods that were not validated. They never proved that the anthrax in the letters actually grew from parent spores in Ivins' flask, as FBI purports. This failed claim forms the linchpin of the FBI's entire case.

Here is the 2011 WaPo editorial on the need for a comprehensive investigation, following release of the NAS report. Today's GAO investigation did not fulfill the WaPo's request to include an investigation of the case against Ivins himself.

Following the NAS report, in October 2011, veteran investigative reporters at McClatchey (Greg Gordon, who is amazing), PBS' Frontline and ProPublica dug deeper into the case than anyone so far had done, and created a TV show, a huge online cache of documents from the case, and several journalistic pieces, like this one. Their work revealed new pieces of evidence that further undercut the FBI's case, like this and this. One article explored the validity of the FBI's scientific evidence.

UPDATE: These reporters write about the new GAO report here.

The National Academy of Science panel couched its conclusions in extremely polite, even deferential language toward the FBI. The NAS committee created new definitions for old words that could only have been intended to confuse readers of the report. (See my detailed discussion of this, below)

If you actually say, out loud, that the FBI faked its search for the anthrax criminal(s), flushed $100 million down the toilet in its most expensive case to date, and deliberately avoided conducting a credible investigation to find the anthrax letters perpetrators, then you question the entire edifice of US law enforcement and imply a conspiracy around an anthrax letters coverup at the highest levels of government, as suggested in Professor Graeme MacQueen's recent book. And that, ladies and gentlemen, you are simply not permitted to do.

Step back from the abyss, get a limited GAO report that still took 2 years of review to see the light of day, and close the door on the anthrax letters case. Got it?

Here is what I wrote about the NAS report following its 2011 release:

Muddying the waters: contradictory NAS Report interpretations, and how the report itself asks to be read
Professor Paul Keim, an anthrax genetics expert at Northern Arizona University and FBI contractor, is claiming the NAS report supports the FBI's case. It doesn't. Please review the report and judge for yourself.

The NAS report has many confusing aspects. But it basically says:
The FBI totally screwed up its data collection of anthrax samples, and it should not be considered comprehensive.
FBI failed to give the committee needed information, although it provided some response (sometimes "tersely") to every request for information.
FBI found a number of morphologically unusual mutants ("morphotypes") in some letters, then chose some morphotypes to study further, but FBI provided no explanation for why only some morphotypes and not all letters were selected.
NAS pointed out that one could not say what expertise and equipment were required, nor how long it would take to produce the amount of spores used, absent that information. (This conclusion challenged FBI claims that Ivins had the equipment and expertise needed, and also challenged the importance made of Ivins' late nights in the lab.)
The assertion that Ivins tried to fool the FBI with the samples he submitted is unsupported.
FBI was chided for failing to use the newest molecular techniques, which could have speeded up the research and helped to clarify the relationship between the letter spores and Ivins' flask of spores.
For example, from page 26 of the report:

"No written explanatory materials were provided with these documents that would fully
inform the committee as to why the analyses were done and how these documents contributed to the FBI investigations and conclusions. The material regarding analyses of the FBIR specimens was coded, often with different numbers for the same sample set. Consequently, the committee spent a considerable amount of time sorting through and attempting to interpret the available materials before it could begin to evaluate the science and consider the scientific conclusions. In addition, much of the information provided to the committee was compartmentalized and sections of some documents were redacted.
When the committee posed questions to the FBI for clarification, the agency was always
responsive; however, responses to questions were sometimes minimal or terse, or were deflected as intruding into the criminal investigation and beyond the purview of the committee despite the committee’s explanation that the questions were of a scientific nature."

And excerpts from page 119:

"The first challenge with the repository was the lack of independence among samples and an incomplete understanding of the provenance of samplesdue to the known history of sharing... FBI scientists and investigators sought to determine the history of shipments among institutions and the genealogical relationships among samples in the repository, but they never obtained a complete record.

Another challenge with the repository was that, since the importance of the mutant genotypes was not fully understood when the subpoena protocol was written, the document was vague (e.g., “use an inoculum taken across multiple colonies”), and was not written in a way that would maximize the chance that variant genotypes in a mixed stock population would be submitted... After the importance of the mutant genotypes became known, there was no request for additional samples using a revised protocol that might have improved the sampling.

A final challenge was that the repository collection process was based on the integrity of the individuals asked to provide samples. If the motive for the repository was to identify the source of the letter material, standards of custody of evidence would dictate that agents of the FBI should have obtained the samples. In most instances, holders of the material were asked to provide samples and send them in. The sender could have been the instigator and may not have complied with instructions, as the FBI alleges with respect to Dr. Ivins."

Yet the report was otherwise couched in the most conciliatory language. FBI was praised whenever possible.

The committee was barred from commenting directly on the guilt or innocence of suspects. In order to get around this restriction and create a report that complied with its contract, while being as specific as possible about whether the science indicted Ivins, the NAS report included tables that presented FBI and DOJ statements, verbatim. Then the report commented on whether the committee agreed with the statements.

Using this method, NAS' report was able to say (page 15):
The results of the genetic analyses of the repository samples were consistent with the finding that the spores in the attack letters were derived from RMR-1029, but the analyses did not definitively demonstrate such a relationship. The scientific data alone do not support the strength of the government’s repeated assertions that “RMR-1029 was conclusively identified as the parent material to the anthrax powder used in the mailings” (USDOJ, 2010, p. 20), nor the role suggested for the scientific data in arriving at their conclusions, “the scientific analysis coordinated by the FBI Laboratory determined that RMR-1029, a spore-batch created and maintained at USAMRIID by Dr. Ivins, was the parent material for the anthrax used in the mailings” (USDOJ, 2010, p. 8).
The report created new definitions to specify strength of association. This goes to the heart of the report's meaning. Here's what the report says, rather oddly, about how its language conveys the strength of an association (see page 41):
"Quantifying an association, as well as the degree of certainty (or uncertainty) in that association, involves statistical methods (see Chapter 6). Common language involves qualifiers, rather than quantifiable measures, of this association and the degree of confidence in it, which can cause confusion among practitioners from different fields that use the terms. Since the interpretation of these qualifiers and the ways in which they are used differ across disciplines (e.g., statistics, science, law, common language), their use by the committee is clarified here. In the chapters that follow, the committee uses the following four qualifiers of association, listed in order of increasing certainty (decreasing uncertainty):
consistent with an association
suggest an association
indicate an association
demonstrate an association
The expression “consistent with” is frequently used in this report and conveys the weakest level of certainty (greatest amount of uncertainty). In general, when the term “consistent with” is used, it means that an association may or may not be present; the available data can neither rule out nor confirm an association. The term “suggests” denotes a greater level of certainty for an association than “consistent with,” but even here the normal use of the word in science denotes a weaker level of certainty than is implied by the word in everyday parlance. That is, the potential for an association is stronger, and the evidence for the absence of an association is weaker, but both are still possible. In contrast, the terms “indicate” and “demonstrate” denote higher degrees of certainty and these are usually reserved for strong scientific conclusions (i.e., less uncertainty, or less likelihood of an absence of an association). All four levels could potentially be quantified with measures of “statistical significance,” but the committee does not assign such measures in most instances because the data at hand are generally not appropriate for such precise quantification of the degree of uncertainty.
In summary, the reader is cautioned to consider carefully the terminology in this report in light of the fact that the qualifiers of certainty used here are those used most commonly in the scientific literature and that these words can carry different weight in common language and in the courtroom."

So the term "consistent with an association" in the NAS-FBI context, implies the weakest possible association. Got that? Keim and the FBI have taken "consistent with" to mean the NAS Report supports the FBI claims, when the report's own definitions state that "consistent with" implies "the greatest amount of uncertainty" about the association. UPDATE: Keim is quoted in the 2/17/11 Global Security Newswire with the following (disingenuous) statement:
Keim disputed news reports suggesting that this week's analysis questions the FBI for naming Ivins as the perpetrator of the attacks. "The committee isn't saying that. ... All the major conclusions that the FBI came to, the committee said, 'Yeah, the evidence is consistent with that.'"
[Sorry for all the mumbo-jumbo, but this level of detail helps explain how opposing sides may each cite this report to claim victory--Nass]

NEWS
Was FBI wrong on North Korea?

- Cybersecurity experts are questioning the FBI's claim that North Korea is responsible for the hack that crippled Sony Pictures. Kurt Stammberger, a senior vice president with cybersecurity firm Norse, told CBS News his company has data that doubts some of the FBI's findings.

"Sony was not just hacked, this is a company that was essentially nuked from the inside," said Stammberger.
While Norse is not involved in the Sony case, it has done its own investigation.
"We are very confident that this was not an attack master-minded by North Korea and that insiders were key to the implementation of one of the most devastating attacks in history," said Stammberger.
He says Norse data is pointing towards a woman who calls herself "Lena" and claims to be connected with the so-called "Guardians of Peace" hacking group. Norse believes it's identified this woman as someone who worked at Sony in Los Angeles for ten years until leaving the company this past May.

After DEA agent pleads guilty to bribery, cases he investigated in limbo
Kevin Moore admitted this month he traded sexual favors to fake offers of reduced sentences

Lawyers taking fresh look at cases possibly mishandled by former Salem police officer

Show Transcript
ROANOKE, Va. -
What to do with large federal methamphetamine trafficking cases impacted by the guilty plea of a Roanoke DEA investigator? Two weeks ago, Kevin Moore admitted he got sexual favors in return for fake offers of reduced sentences.

MORE FROM WDBJ7.COM

Salem police officer pleads guilty to bribery charge, admits trading fake legal favors for sex
At least three meth distribution cases, some with nearly a dozen defendants have had delays because Moore was the case agent.

The one impacted the most is from Grayson County near Galax where Moore worked with the Twin County Drug Task Force. Traffickers from California allegedly brought in pounds of meth and buried it in the woods next to a stash house.

Moore wrote the criminal complaints against the ringleaders of the operation which now has 11 defendants. Four of them have a jury trial next year that still needs to be set because of the mess. Most of the others pleaded guilty right around the time Moore was first investigated for his own criminal acts.

Six were supposed to be sentenced around this time but that's now delayed and some lawyers are taking a fresh look at their cases to see if Moore maybe mishandled anything.

They tell WDBJ7 they don't have any evidence of that right now, but because Moore was meddling with other defendants, it certainly is due diligence.

"I want to know if there's more or not," said attorney David Damico, who represents one of the defendants. "I want to fully investigate it to see about any implications for my client."

Damico's client, Cristian Perez, pleaded guilty to two counts of conspiracy to distribute meth and four counts of actually dealing it. The plea happened in late September, a few weeks after the first woman came forward alleging Moore offered a possible lighter sentence for her crimes in exchange for a sex act in his DEA vehicle. Perez had a sentencing set for January 5, but it's been continued without any new date set.

Survey: Most writers in free countries worried about spying

01/05/15 11:04 AM EST
Three-quarters of writers in liberal democracies are concerned about government surveillance and one-third have censored their own writing because of those fears, according to a new survey.

The analysis from the Pen American Center released on Monday is harshly critical of U.S. spying powers and, its authors said, proves why Congress needs to take action to rein in agencies such as the FBI or National Security Agency (NSA).

“Fear of government surveillance is prompting many writers living in democratic countries to engage in the kind of self-censorship associated with police states,” executive director Suzanne Nossel said in a statement. “We’re all well aware of writers in places like China and Russia who must live life knowing they are always being watched—it’s disturbing to recognize that those in the U.S., Canada, and Australia are now coming to adopt similar behavior.”
The survey covered 772 writers living in 50 countries, and found that 75 percent of writers in democratic

All of the conciliatory talk from the Justice Department about leaving journalists out of its war on leaks appears to be just that — talk.
That's the only logical answer to the question of why New York Times reporter James Risen was on the witness stand in federal court Monday, being asked about confidential sources and stories.
The feds are attempting to prosecute Jeffrey A. Sterling, a former CIA officer accused of giving Risen classified information about a botched operation involving Iran and its nuclear program.
The government's attempt to pressure Risen is far from the only episode in which the administration has tried to get at those suspected of revealing sensitive information through journalists.

Solitary confinement is a form of torture. That's the message behind the movement to end solitary confinement of prisoners in the United States. Actions take place on the 23rd of every month-representing the 23 hours per day that many prisoners stay locked behind bars. Over the past two years what began as a statewide grassroots movement to end solitary confinement of prisoners in California merged with prisoner support groups nationwide in spreading the word and staging public actions in numerous states.

A group of activists and clergy condemn the prosecutor's office for ignoring the judge's finding of probable cause for arrest, deciding to rely on a grand jury process instead. "It is not the grand jury's role to file the initial charges," the letter points out. "For the vast majority of people, charges have already been filed against them prior to a prosecutor seeking an indictment before the grand jury".

Black Mass: A Mass of Black Lies
September 8, 2015

The movie based on the book is out this month. I will go to see it at some point and write about it but it is not something I will rush out to see. I write now to remind those of you who have a particular interest in this matter and will attend the movie to keep certain things in mind.

I have read a BBC review of the movie that gives a good overview. There are other reviews out there that gush with superlatives when describing the acting of Johnny Depp but the BBC review tells us: “there’s Depp’s hair and make-up. Unable to resist the lure of the dressing-up box, he has a bald wig, brown joke-shop teeth, dazzling contact lenses, and skin more cadaverous than he had when he played a vampire in Dark Shadows. Was the real Bulger ever as odd as Depp is in Black Mass? ”

Keep in mind that this is a movie and will have little connection with the real facts of Whitey’s life. The book, Black Mass, the title a slap at the religion of the parties involved, was written by two Boston Globe columnists with a huge animosity toward Billy Bulger and South Boston. The BBC review noted the movie: “is the second film at the Venice Film Festival to present Boston as a city mired in toxic cronyism second to present the Boston Globe newspaper as the only institution willing to clean it up. “ What you will be watching is a paean to the fiction that the Globe was somehow instrumental in bringing Whitey to justice.

If you want to buy that you must know in 1988 the Globe Spotlight Team (which included the two authors of Black Mass) wrote a series about both Billy and Whitey Bulger. It had nothing but good things to say about Billy; it only told us that Whitey may be a bad guy with a connection (special relationship) to the FBI. It never hinted at Whitey being involved in murders and by 1988 Whitey’s murders were in his past.

We understand that this is a movie and that although it is supposedly closely connected to Whitey’s life most of what will be involved of necessity are great embellishments.

I can suggest the following will be highlighted even though there is no real proof outside of the imagination of the Black Mass authors that these matters happened. First, there will be a showing of a relationship between John Connolly and Whitey while they lived in the projects. There was none. Given the age difference (11 years) that is an impossibility. John Connolly made up a couple of encounters with him which certainly never happened as anyone who grew up in Old Harbor Village knew.

The Black Mass suggestion that Connolly brought Whitey on as an informant against the Mafia is nonsense. He was the last person who would have had any information on the Mafia in 1975, The guy with the information, Steven Flemmi, was already an FBI informant and being handled by Connolly (cleverly omitted in the book). The years would show that it was Flemmi and not Whitey with access to the Mafia inside information.

Connolly was not off on some sort of secret plan with Whitey. This will be interesting to watch how the movie handles this. From the top of the FBI, through each Boston agent in charge and assistant agent in charge, many supervisors and a multitude of other agents, including clerks in the Boston FBI office, it was well known in the FBI that Whitey was an informant. He was approved to be one over and over again and to be part of the FBI secret Top Echelon Informant program.

There is no evidence, as shown by the 1988 Spotlight Report and what has been shown to date that Connolly knew Whitey had murdered anyone. In so far as the movie shows that Connolly had any knowledge of or connection to any of the murders then chalk that up to the fiction of the movie. My recollection is that Black Mass never suggested Connolly knew about any of Whitey’s murders.

Unfortunately if the movie does not talk about the Top Echelon Informant program and how the FBI recruited guys like Whitey and had them handled by FBI agents whose job it was to protect them or as another agent said “to keep you safe.” The movie gives us half a loaf of reality and a half of make-believe.

I haven’t seen it. When you do keep in mind some of the things I mentioned. It will make you better understand how fiction can become reality.

Former FBI director Mueller warns of ongoing terrorism threat, plays down threats to privacy
9/19/2015

http://coloradostatesman.com/content/99 ... ts-privacy" onclick="window.open(this.href);return false;
Former FBI Director Robert Mueller minced no words Tuesday in a two-hour public interview with television talk show host Aaron Harber about the ongoing threat of terrorist attack he said shadows the United States. He also attempted to allay concerns about national security state overreach that could trample the privacy rights of American citizens.

Mueller told the audience of mostly students, politicians and law-enforcement representatives that filled a 500-seat conference room at the downtown Marriott Denver that his experience as the second-longest serving head of the FBI — after director-for-life J. Edgar Hoover — taught him that the country’s intelligence organizations overwhelmingly were staffed with personnel who knew that integrity was crucial to maintaining the public trust essential to the work.

Former FBI Director Robert Mueller talks about terrorism and civil rights during an interview with Aaron Harber on Sept. 15 for Harber's TV show before an audience of some 500 at the Marriott Denver.
Photo by Pat Duncan/The Colorado Statesman
“The balance between privacy and national security is something we knew we would have to work at every day,” he said.

“We get thousands of applications every year. But the average age of new agents is 30 years old. That’s because the most important qualities we look for are judgment and maturity. Americans are giving great power to the agency to affect people’s lives.

“We take new recruits to the Holocaust Museum on the Mall in Washington to demonstrate the power and responsibility have as agents of the government.”

Mueller said that the checks and balances safeguarding against abuse have worked well, although they have been subject to criticism in the media and on Capitol Hill. He defended the Foreign Intelligence Surveillance, or FISA, court, which is closed to the public and has been called unjustifiably “secret” and written off by critics as a rubber-stamp factory serving the homeland security industry.

“We are the only country where [government intelligence agencies] have to go through a court at all,” he said. “The third branch of government is a pretty good guardian.”

Even among critics, Mueller enjoys heightened credibility.

Former Interior Secretary, U.S. Sen. and Colorado Attorney General Ken Salazar introduces former FBI Director Robert Mueller at a taping of the Aaron Harber Show on Sept. 15 in Denver. Salazar recalled that he got his start in politics as a young attorney in the early 1980s when Harber hired him to sue the Colorado secretary of state.
Photo by Pat Duncan/The Colorado Statesman
He came into the job the week of 9/11 and he learned fast he would have to remake the organization. He told the audience he briefed President George W. Bush and started listing off the investigation he was running, the progress he was making identifying the men and the terrorist networks behind the attacks.

“He said, ‘That’s fine. I expect that, but I want to know what you’re doing to prevent the next attack?’”

Mueller said he was flummoxed. He said he knew then that the investigative and prosecutorial work the agency was famous for doing would have to take a backseat to the more vague work of preventative counterterrorism.

Mueller also earned vast stores of goodwill among national security skeptics for his role opposing the effort by Bush cabinet members in 2004 to pressure the hospitalized Attorney General John Ashcroft to reauthorize a domestic surveillance program the Justice Department had deemed illegal. Mueller, along with Ashcroft, Deputy Attorney General James Comey and their staff threatened to resign, leading Bush to pull back on the plan and rework the surveillance program.

The audience seemed persuaded by Mueller. Cyber security hacks and breaches make news at a regular clip. The information leaked by national security contractor Edward Snowden have generated a cottage industry of news programs, newspaper series, bestselling books and movies and spurred protests at forums like the one hosted by Harber Tuesday. But there was none of that, not even many tough questions, which seemed odd, especially given that Harber had marketed the night as a “special civic engagement forum” and as a “no-holds-barred” opportunity to ask Mueller questions on any subject. And Harber was good to his word, keeping the former director on stage for two hours and the microphone open until the last person lined up behind it had asked his question.

Aaron Harber interviews former FBI Director Robert Mueller during a taping of a special edition of the Aaron Harber Show on Sept. 15 at the Marriott Denver. Mueller spoke with Harber and answered questions for more than two hours from an audience composed mostly of law enforcement personnel, high school students and dignitaries.
Photo by Pat Duncan/The Colorado Statesman
It might have seemed odd that the students in attendance seemed as taken with Mueller as the adults.

At a forum on national security the week before in Denver, MSNBC “Hardball” host Chris Matthews said he thought it was young people who were most concerned with unconstitutional government snooping.

“It’s millennials,” he said. “They’re very privacy-conscious, like my kids. But, you know, millennials, they don’t have houses or cars. Their phones are their homes. It makes sense they’re concerned. My email is boring. Who would read my email? I don’t care.”

Matthews said that our relation to our digital lives might influence whether we see Snowden as a leaker or whistleblower, hero or a traitor for turning over vast information on government spying programs to journalists for publication. Matthews seemed unsure on the question. Mueller was not.

“[Snowden] has done institutional damage to our capabilities when it comes to preventing terrorist attacks,” Mueller said.

He said the government was only collecting metadata, although he gave an example that demonstrated how valuable and how revealing that metadata can be.

He recalled the moment agents informed him they had identified the Boston Marathon bombers in 2013.

State Reps. Rhonda Fields, D-Aurora, and Beth McCann, D-Denver, visit at a reception prior to the taping of a special edition of the Aaron Harber Show featuring an extended interview with former FBI Director Robert Mueller on Sept. 15 at the Marriott Denver.
Photo by Pat Duncan/The Colorado Statesman
“My greatest concern at that moment was: Will there be another attack? So I wanted to know who did [the bombers] talk to? Are there others who might be planning a subsequent attack?

“Their phone records were readily available. We could see that. Do we want to lose that capability?”

Near the end of the event, a high school student from Pueblo asked what Mueller thought was the greatest threat facing the country. Mueller didn’t hesitate. He said the Islamic State operating in the Middle East.

There is the domestic threat, but there is the “more immediate threat posed to Americans overseas,” he said, conjuring images of kidnappings and the videos of beheadings in the desert that have gripped cable news watchers for years.

Another questioner asked about the alleged threat posed by immigrants crossing the southern border of the United States — the “killers and rapists” Republican presidential frontrunner Donald Trump famously lamented Mexico is ushering into the country.

“Um, hmm, no comment on that one,” Mueller said.

It was the only substantive question Mueller took a pass on answering the entire night. (He also punted when asked what actor he would choose to play him in the movie version of his life.)

The last question also came from a student.

Can humans can learn to live in peace with one another within the next 500 years, absent an alien invasion? the student said, roughly, only with more words and pauses between the words.

Harber repeated the question out loud, sort of translating for the director.

Mueller barely grinned. “No,” he said, and didn’t elaborate.
