Created overnight during the Siege of the Alamo, Texas adopted this Declaration of Independence and became a Republic. It is the only state that can "legally" fly its flag over that of the United States.

Yes and we need to recognize that in 1836 the Mexican state of Texas SECEDED from the Mexican republic. That the original 13 colonies SECEDED from the British Empire. Secession is a fundamental tool regarding the creation of the American Republic.
Lincoln did not end that legitimate means of restoring liberty, he only proved how our supposedly Constitutionally restrained central government would react when any state(s) took that course. And he proved the anti-federalist were correct in their fears of such concentration of power.
